The basics of probate that my clients—and really anyone—should know is that it’s not a scary process. Probate is simply the process by which someone is given authority, usually by the court, to gather up a person’s assets—everything they own, whether that’s Uncle Joe’s car, your grandmother’s house, or a bank account.

Once those assets are collected, you pay any outstanding debts, and then distribute what’s left to the appropriate people. This happens whether the person died with a will or without one. If they die without a will, the state they lived in has a plan for where their things go—usually to their closest family members.
